Marcy works with clients to help them through an uncontested divorce in a number of ways. Sometimes clients come to Marcy and they already have a property settlement agreement prepared.  They just need an attorney to review that document. All the client needs from Marcy in that situation is a regular consultation for which she charges her normal consultation fee.

Sometimes clients come to Marcy and they and their spouse have already decided on the terms they want in their agreement, and her job is simply to prepare the agreement based on what they say they want. The advantage to the clients here is that a lawyer is preparing the document so they can be sure the language is appropriate to achieve their intentions regarding their children and property division, and they can also be advised regarding any questions they have.

When the parties are basically in agreement and just need the document prepared, Marcy typically charges a flat fee for this service. Even though the parties are in agreement, though, Marcy still can only represent one of them.  It’s always wise for the other party take the agreement to another attorney for a consultation and review of the draft agreement.

Finally, there are times when the parties do not even need an agreement. If they have been separated for over a year and have no children and no joint property or debt, then they just need to go through the process of filing and finalizing the divorce through the courts. As long as Marcy knows that both parties are cooperating and want to finalize the divorce, she will charge a flat fee for this service as well.
